Jordan Watson’s article, “Tort Immunity Arising from Covenants to Insure: The BC Court of Appeal Confirms Bar to Subrogated Claims“, from the January 10, 2013 issue of Insurable Interest was republished in February 2013’s Canadian Insurance Law Reporter. The article discusses the BCCA decision in Kruger Products Limited v. First Choice Logisitics Inc. and suggests that tort immunity based on covenants to insure is an expanding rather than contracting sphere.
